What we can do for you
Will
A legal document that allows you to express your wishes regarding the distribution of your assets upon your death. It may also contain instructions for your funeral, the appointment of a liquidator of your estate, and a guardian for your minor children.
Mandate of protection in anticipation of incapacity
A legal document that allows you to appoint one or more persons of trust to make decisions on your behalf in the event of your mental or physical incapacity. The mandate covers everything from financial management to medical decisions and personal affairs.
Homologation of a protection mandate
Procedure whereby the court verifies the validity of the mandate and the mandator’s incapacity. Medical and psychosocial assessments must be provided to the court. If there are no objections, the notary can carry out the entire procedure and submit the file to the court for judgment.
General power of attorney
Legal document that allows your mandatary to represent you in the administration of your property/business while you are still capable. Can be modified or revoked at any time.
Special power of attorney
Legal document that allows your agent to represent you in a specific situation, such as the sale of a property.
Marriage or civil union contract
A legal document allowing married or civil union spouses to determine how their property will be managed during their married life.
Wedding celebration
The notary reads the articles of the Civil Code of Quebec concerning the effects of marriage. The future spouses and witnesses then sign the declaration of marriage with the notary.
Agreement between spouses
A document that enables a couple to establish rights and obligations between them in various areas such as property management, finances and family responsibilities.
Amicable divorce
Together, the spouses work out a divorce agreement with their notary, which is then submitted to the court for approval. This avoids court hearings and protracted disputes.
Intra-family adoption
Adoption of a child who is already biologically related to the family.
Family mediation
Enables spouses to reach an agreement on the effects of their breakup. Many hours of mediation are paid for by Justice Québec.
Personal law support
Each step of the process is designed to carefully guide you through personal legal matters, such as the protection of vulnerable persons, the drafting of wills and mandates in the event of incapacity, or advice on family rights. Our aim is to make every step clear and reassuring.
Before our first meeting
To prepare for your first meeting with the notary, we invite you to consult the “Will” and “Mandate of Protection” forms, which can be found in the “Forms” section of our website.
These forms will help you prepare for the notary’s questions and give you an overview of the topics covered.
At your first appointment
During this first testamentary interview, the notary will take the time to get to know your family and marital life. He or she will ask questions about your estate and your wishes regarding your will and/or mandate for protection in case of incapacity.
At the last appointment
Following this, a second
meeting will be held to read the legal explanation and sign
the deeds. Finally, the notary will register your documents
with the Chambre des notaires du Québec and provide you with copies of the signed documents.
